Privacy Policy

Effective date: October 15, 2026

Who is responsible

Ashworth Private Holdings LLC ("ASHWORTH", "we", "us") operates ashworthprivate.com and is responsible for the personal information described in this policy. Our registered business address is 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, United States. This is a registered address, not an office open to the public. Privacy requests can be sent to info@ashworthprivate.com.

What we collect and why

When you use the contact form or write to us, we receive the name, email address, optional enquiry topic and message you provide, together with your confirmation that you have read this policy. We use this information only to read and answer your enquiry and, if you ask us to, to discuss and prepare a possible engagement.

When any page is requested, the web server that hosts the site automatically processes technical data such as your IP address, the date and time of the request, the page requested, the browser's user-agent and error records. This is needed to deliver the page, keep the service secure and investigate faults.

To limit abuse of the contact form, the server keeps a one-way hash of the sender's IP address with the times of recent submissions for about ten minutes. The content of your message is not written to any log by the website.

Please do not send identity documents, passwords, payment-card details, health information or other sensitive data through the form or by email. The form does not ask for them and we do not need them to answer an enquiry.

Legal bases

Where the EU or UK General Data Protection Regulation applies, we rely on the following bases:

  • Steps taken at your request before entering into a contract (Article 6(1)(b)) when you ask about a possible engagement.
  • Our legitimate interest in answering ordinary business correspondence and in keeping the website and mail service secure (Article 6(1)(f)). We have balanced these interests against your rights and keep the data involved to a minimum.
  • Compliance with legal obligations (Article 6(1)(c)) where we must keep certain records.

We do not send marketing messages and do not ask for marketing consent through this website.

Cookies and browser storage

The website does not use advertising cookies, analytics, tracking pixels or social-media plugins, and it loads no fonts, scripts or content from third-party servers. It stores two small items in your browser's local storage: your language choice, only if you select a language, and a record that you have seen the storage notice. Both stay on your device and are not sent to us. Details are in the Cookie Policy.

Who processes the data

  • Our hosting provider, Hetzner Online GmbH (Germany), provides the server on which the website, the contact form handler and the info@ashworthprivate.com mailbox run. The server is located in the European Union. Messages sent through the form are delivered by that server's own mail system to our mailbox; no external form or email service is involved.
  • People authorised by Ashworth Private Holdings LLC to answer enquiries.
  • Professional advisers or public authorities where the law requires it or where it is necessary to establish, exercise or defend legal claims.

We do not sell personal information and do not share it for cross-context behavioural advertising.

International transfers

The server is located in Germany. Ashworth Private Holdings LLC is a United States company, so personal data may be accessed from the United States when we answer your enquiry. Where the GDPR applies to such a transfer, we rely on the safeguards available under applicable law, including Article 49(1)(b) GDPR where the transfer is necessary for pre-contractual steps you have asked for. You can contact us for more information about these safeguards.

How long we keep data

  • Enquiries and our replies: for as long as needed to answer and follow up, and no longer than 24 months after the last exchange, unless the enquiry leads to an engagement, in which case the engagement's own retention terms apply.
  • Web server logs: kept for a limited period for security and fault diagnosis and removed by automatic rotation on the server.
  • Rate-limit records: about ten minutes.
  • Language and notice choices in your browser: until you clear them, which you can do at any time from the "Cookie settings" link in the footer or through your browser.

Your rights

Depending on where you live and the law that applies, you may ask to access, correct, delete or receive a copy of your personal information, to restrict or object to its processing, and to withdraw any consent you have given. Residents of the EU and UK may also complain to their data-protection supervisory authority.

Residents of US states with consumer privacy laws, including California under the CCPA/CPRA, may have rights to know, access, correct and delete personal information and to opt out of its sale or sharing. Those laws apply only where the business and the request meet their thresholds; we do not sell or share personal information in any case. We will not discriminate against you for exercising a privacy right.

To make a request, write to info@ashworthprivate.com. We may ask for reasonable information to confirm your identity, and we aim to respond within one month or within the period set by the applicable law.

Security

The website is served over HTTPS, the form handler validates every field on the server and the mailbox is protected by individual credentials. No method of transmission or storage is completely secure, but we take reasonable measures appropriate to the small amount of information we receive.

Children

This website is meant for businesses and adults. It is not directed to children and we do not knowingly collect their information. If you believe a child has sent us information, contact us and we will delete it.

Changes to this policy

If we change how we process personal information, for example by adding a new service provider or an analytics tool, we will update this page and its effective date before the change takes effect and ask for consent where the law requires it.
